New changes to Pre Nuptial agreements

Year Published: 2011

The long awaited consultation paper on Pre Nuptial agreements has been published by the government. It proposes to reform the law and seeks views on a number of options. This is not the first time changes have been proposed but following the Radmachher case the government has had to act, as the courts should not be responsible for making law to this extent – they should be interpreters.

The new law, when it comes in, will have a radical impact upon second marriages which is a huge growth area and one where ‘Pre-nups’ are very relevant and important. They can ensure that the children of a first marriage are not effectively disinherited by a second marriage.

They are not just for celebrities, but for every person thinking of marriage now or in the future – but they must be prepared very carefully and thoroughly. Always seek expert advice.
