The Government has released details about the new protocol requiring divorcing couples to seek mediation. Couples are required to attend one awareness session in order to assess whether a case is suitable for mediation or not. In practice, this may seem like a good idea, as mediation is one way of resolving such disputes on an amicable basis. The only problem is that there are insufficient mediators available to undertake the work.
This could lead to backlogs and delays in couples moving forward with their lives. It is also often apparent immediately that mediation is inappropriate in a case and that court proceedings will be necessary, and in those cases, the referral will be a waste of time and costs.
