SAS Daniels LLP advises local surgery on move to state-of-the-art building

A local surgery has opened its doors to patients at its new state of the art facility. Springfield Family Surgery, based in Eccles, Manchester, was advised on relocating from its current practice by North West Law Firm SAS Daniels LLP.

The surgery, a partnership made up of six GPs, needed to terminate the existing lease and create a new agreement to relocate from its current property to a new, purpose built facility on Liverpool Road in Eccles.

In order to negotiate the lease it called on SAS Daniels to help them avoid the pitfalls of signing a lease that would not qualify for reimbursable rent from the government and also identify changes needed to the partnership agreement because of the terms of the lease.

This meant the practice premises were built to a specification, allowing for a modern, spacious environment including disabled access and plentiful parking. It is now equipped to offer local patients the best and latest in healthcare.

Changes to NHS legislation have seen changes in the health care system, particularly for general practitioners. The abolition of Primary Care Trusts in April of this year means that more commissioning responsibility now falls to local GPs, like those of Springfield Family Surgery. GPs have become the direct overseers of NHS funds, introducing an element of business management to their roles.

These legislative changes have changed the way in which practices are run, something SAS Daniels’ Business Services Partner is aware of: “When working with the doctors, it was important to recognise that more and more doctors are finding themselves as business owners. We had this at the forefront of our planning, when creating the lease and protecting all the doctors in the partnership, no matter what the long term goals.

It was imperative that all the doctors of the partnership were protected in the eventuality of retirement, so that no doctor was left in a position where they would be unable to retire due to a post retirement liability under the lease. In order to combat this, we advised amendments to the partnership agreement where it was not possible to alter the lease to protect those partners. The Springfield Family Practice provides a vital service to the local community and the work we have done with the GPs ensures they can continue to do this at their new, updated, premises.”
