The type of funding needed for your claim depends on the type, value and complexity of it. We will discuss with you which type of funding is the most appropriate. Below are some examples of how we will fund your claim:
No win, no fee agreements
These are also known as conditional fee agreements. If you do not recover compensation, we will not charge you for the work done on the case. However, please note that this does not apply to disbursements (such as medical record fees, court fees, medical or expert report fees) which are your responsibility. Any disbursements paid by you will not be refunded if your case is unsuccessful. We will discuss the funding of disbursements with you.
If you recover compensation, the fees we are entitled to charge you will normally be recovered from the other side. There may be a deduction from your compensation which is known as our ‘success fee’. Any disbursements you have paid for or contributed towards will be refunded to you.
Contingency fee agreements
These are in essence where we take a cut from your compensation if your case is successful. There is no cut if your case is unsuccessful. These agreements are only suitable for personal injury claims involving untraced drivers (‘hit and runs’) and victims of a crime of violence. Any claims in these cases are to a government scheme which does not cover our costs of assisting you.
The government have withdrawn legal aid for all types of personal injury case except for unusual test cases. The same applies to clinical negligence cases although it is still possible to obtain legal aid for wrongful birth cases.
Legal expenses insurance
If you have been involved in a road traffic accident, you will probably have legal expenses insurance on your policy which may cover the cost of bringing such a claim. That cover may extend to funding your claim via ourselves. If you have been involved in any other type of accident or been a victim of clinical negligence, you may have legal expenses insurance on your home contents or buildings insurance. This may cover the cost of bringing such a claim and that cover may extend to funding your claim via ourselves.
These are available upon request and can be used to fund defending personal injury claims, representation at inquests and assisting with complaints about medical care.
