How much will a divorce cost?

As an example, a divorce may involve one or more of the following aspects which need to be dealt with:

  • Children – determining who the children will live with and the extent of contact they will have with the non-resident parent.
  • Financial settlement – dealing with the division of assets such as the house, working out whether spousal maintenance is payable and sharing pensions.
  • The divorce – legally ending the marriage.

The amount of work involved will vary with each case and will usually depend on how much you and your ex-partner agree or disagree.

Depending on the attitude and willingness of both parties to reach an agreement negotiations can be either short or drawn out and as a result affect the overall cost.

Who’s responsibility is it to pay the legal fees for a divorce?

In the majority of cases, both parties will have their own solicitor and will be responsible for their own legal fees. However, It may be possible to include the payment of legal fees as part of the financial settlement.

You could also apply for a Legal Costs Order to enable you to finance the court proceedings from the outset.
