A client was in the process of a divorce who owned their own business and wanted to protect the estate for the benefit of the children. They also wanted to mitigate the potential for a claim being made against the estate in the event of death before the finances were concluded. Our Wills & Wealth Planning team reviewed the structure of the business to ensure that those assets would pass to the children whilst including potential provision in the will for the soon to be ex-spouse, with a clause which would deter the spouse from making a claim if matters were not settled before death. We worked closely with our specialists in the Family and Corporate teams to provide our client with holistic advice to ensure they had the best possible outcome. The client was happy with the solution we suggested as it dealt with all the major concerns which were causing sleepless nights.
