Last year Bertie and Jessie Woods from Hertfordshire set a world record after ending their 36 year marriage, both aged 98 and recently Al Gore and his wife announced their divorce only weeks after celebrating their 40 wedding anniversary. It may be a surprise to some that divorce amongst the over sixties is on the increase.
In 1997 9,052 couples aged sixty and over were divorced but by 2007 the figure had increased to 13,678. The figure continues to go up year upon year although the number of divorce petitions being issued is on the decline. Why is this?
People now live longer, are more active and once the children have left home, women in particular, wish to become independent and it is women who start seven out of ten divorces.
Some people take the plunge again and enter a second marriage and have far more in terms of assets than they entered their first marriages with. It is therefore vital that legal advice is taken prior to a second marriage, especially bearing in mind the high failure rate. Some protection can be afforded by entering Prenuptial Agreements or by putting assets in trust for future generations.
