We acted for the proprietor of a new design business who wished to continue his relationship and work he had established whilst he worked for a previous employer. The previous employer sought an interim injunction to prevent the use of the designs and for their return.
After a detailed investigation we were able to demonstrate and establish that:
- The designs did not belong to the previous employer in any event;
- The previous employer had suffered no loss and we would adduce evidence that the previous contact would not use the employer again.
We were able to negotiate a settlement without the need for filing a defence or any evidence whereby the designs were returned and undertakings given. There was no order as to costs.
As a result, we protected our client’s fledgling business which has now gone from strength to strength and provides advice and designs for major clients in their field.
