We provided advice to the Trustees of a Will Trust regarding the legal title to the property which was contained in a Trust. We also advised on how to structure the sale of the farm in parts with planning permission for the conversion of some of the farm buildings. Following our advice the farm sold in three parts and we ensured there was long term benefit for the beneficiaries of the Trust by imposing overage in two of the sales.
During this case there was a defective access issue that had to be addressed by obtaining a bespoke indemnity policy to enable the three sales to proceed. Our role was to, initially, pre-empt any title issues and to structure the sales so they could complete in the most cost effective manner. We also worked closely with a firm of land agents and our client’s tax adviser.
