We represented a group of landowners in the multi million pound sale of their land to a national house builder. The land had the benefit of outline planning permission for 196 houses and was split in to two parcels. There was a farm access track dividing these parcels. The planning permission covered the whole site and the new estate roads needed to cross the access track. The owner of the track could not be traced and it was not maintained by the council. This was a real sticking point and could have been a big issue for the deal. However, we suggested a solution to the council and the house builder to allow the road to be constructed and adopted by the council. This solution meant that we could get contracts exchanged on terms that were agreeable to all parties and ultimately achieve a sale of the land that might not have otherwise happened.
