There is a duty of full and honest disclosure in all divorce and separation cases where financial issues are raised. Where there are court proceedings, this is undertaken by completing a document called ‘Form E’. It can be a very long and detailed process to complete the form and often, accountancy advice is required as well as a solicitors input, but do not let this put you off. This document forms the basis of a party’s case so it is crucial to complete it accurately and with the fullest information. Failure to do so can lead to disadvantages during the court process.
Failure to complete and file it at all can be a whole lot worse! In a recent case, a father failed to make disclosure of his financial position via form E, by ignoring the court’s deadline for filing and even ignoring a contempt warning by the court. The outcome was that he has now been found guilty of contempt of court and has been committed to prison for fourteen days.
