We acted for a private client who had obtained incorrect and negligent advice from a previous firm of solicitors, concerning a probate claim he had made and which arose from his late father’s estate. The previous advice resulted in the claim being dismissed and an order for substantial costs made against the client.

We were instructed to issue proceedings for possession and sale of a property registered in the joint names of the bankrupt and his wife. The application was contested by the bankrupt and the bankrupt’s wife on the basis that the bankrupt did not have an interest in the property.

We acted for an insolvency practitioner who had been appointed as the trustee in bankruptcy of a bankruptcy estate. Further to Section 283A of the Insolvency Act 1986 (the “Act”) the client’s interest in a property needed to be ‘realised’ as defined in the Act by 15 August 2015. We received instructions to ‘realise’ that interest by issuing proceedings for possession and sale on 13 August 2014 in order to prevent the client’s interest in the property automatically reverting to the bankrupt.

Our Estate Administration & Probate team acted as executors with a lay executor for a generous patron who lived in the Chester area, who loved his cats and wanted to be cremated with the remains of his former feline companions.

He didn’t have any close family and we were involved in arranging his funeral in accordance with his wishes, rehoming his sole surviving cat and then sorting out his business and personal effects which were sold.
